Speed eCam Terms of Service

Welcome to Speed eCam - our camera app for mobile and desktop! Before you start capturing and editing your photos, please take a moment to read through our Terms of Service. Speed eCam is a trading name of C Code Ltd, with registered address at Sierra Quebec Bravo, 77 Marsh Wall, London, E14 9SH and by using Speed eCam app and software, you agree to abide by these terms:

1. Acceptance of Terms

By accessing or using Speed eCam app and/or software, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use Speed eCam app or software.

2. Use of the App

You must be at least 13 years old to use Speed eCam app and software. By using our services, you warrant that you are at least 13 years old.

3. User Accounts

Some features of Speed eCam app and software may require you to create a user account. You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. Content

a. Creator Content: You are the creator of the content you produce using Speed eCam app and software. You maintain full ownership and control over what you create.

b. License You Grant to Us: By utilizing our services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content. This license empowers us to operate and enhance our services, ensuring an optimal experience for all users. However, it doesn't transfer ownership of your content to us. You retain the rights to your creations.

c. No Storage: Speed eCam app and software do not serve as storage facilities for your content. It is your responsibility to securely store your content externally. If you are using a free account, please note that we will store your photos for up to 3 days. If you are in a paid account, please refer to the current packages for the length of time we store your photos. After deletion, we are no longer responsible for the data/photos. If your account remains closed, inactive, or suspended for an extended duration, we reserve the right to permanently delete your account or any creator content associated with it, following our standard business procedures.

5. Prohibited Conduct

You agree not to engage in any prohibited conduct while using Speed eCam app and software, including but not limited to: violating any laws or regulations, infringing upon the rights of others, interfering with the security of our services, or transmitting any harmful or malicious code.

6. Paid Services

a. Fees and Payment: While you can capture and edit a predetermined number of photos for free each month, exceeding this limit may prompt you to upgrade your packages. Please note that the limit for free photos may vary over time. For current package fees and photo storage length times, please refer to the packages description area on this website. By utilizing our paid services, you agree to pay all applicable fees and charges incurred in connection with your subscription.

b. Automatic Subscription Renewals: Upon subscribing to our paid services, your subscription will automatically renew on a monthly basis, unless you choose to cancel it. This ensures uninterrupted access to our premium features and services. You authorize us to charge your chosen payment method for the renewal fee, unless you opt out of automatic renewal.

c. Cancelling Your Subscriptions: You have the flexibility to cancel your subscription at any time, without incurring any cancellation fees. To do so, simply navigate to your account settings and follow the cancellation instructions provided. Please note that cancellation requests must be submitted before the renewal date to avoid being charged for the subsequent billing cycle. Once cancelled, your subscription will remain active until the end of the current billing period, after which you will revert to the free plan.

7. Your Rights

a. Your Rights with Respect to Our Services: You have the right to use Speed eCam app and software in accordance with these Terms of Service. This includes the right to access all features and functionalities provided by our services for your personal, non-commercial use. You can utilize Speed eCam app and software to capture, edit, and manage your ecommerce photography efficiently. Additionally, you have the right to manage and control the personal information you provide to us, ensuring its accuracy and privacy in line with our Privacy Policy.

b. Your Rights with Respect to Beta Services: At times, we may offer beta services or features for testing and evaluation. As a user, you have the right to participate in beta testing voluntarily. This grants you the opportunity to provide feedback, suggestions, and insights to help improve these services. However, please be aware that beta services may not be fully functional or stable, and we reserve the right to modify or discontinue them at any time. Your participation in beta testing is entirely optional, and you can opt out at your discretion.

8. Our Rights

a. Our Rights with Respect to Our Property: We retain all rights, title, and interest in and to our app, software, and any associated intellectual property. This includes but is not limited to copyrights, trademarks, trade secrets, and proprietary technologies. You agree not to reproduce, modify, distribute, or create derivative works based on our app or software without our prior written consent.

b. Our Rights with Respect to Feedback: We welcome feedback, suggestions, and ideas from our users to improve our services. However, by providing feedback or suggestions, you acknowledge and agree that we have the unrestricted right to use, modify, adapt, publish, translate, distribute, and incorporate such feedback into our app, software, or other products and services. You waive any claims to compensation or ownership rights for any feedback provided.

10. Acknowledgment of Image Recognition Technology

You acknowledge and agree that Speed eCam app and software may utilize image recognition technology to improve user experience and provide additional features. By using our services, you consent to the use of this technology.

11. Term and Termination

These Terms of Service will remain in full force and effect while you use Speed eCam app and software. We reserve the right to suspend or terminate your access to our services at any time for any reason, including but not limited to violation of these terms.

12. Informal Claim Resolution and Arbitration

In the event of any dispute arising out of or relating to these Terms of Service, you agree to first attempt to resolve the dispute informally by contacting us directly. If the dispute cannot be resolved informally, you agree to resolve any claim or controversy at law or equity through binding arbitration conducted by a mutually agreed-upon arbitrator. The arbitration shall be conducted in accordance with the rules of the arbitration institution chosen by mutual agreement. Any judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Speed eCam app and software. Your sole and exclusive remedy for any dissatisfaction with our services is to stop using them.

While you are taking your product photos using our services, it's important to note that in the event of any technical issues preventing the saving of photos, we cannot be held responsible.

15. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of Speed eCam app and software or any violation of these Terms of Service.

16. Changes to Terms

We reserve the right to modify or revise these Terms of Service at any time. Any changes will be effective immediately upon posting the revised terms on our website or within our app. Your continued use of our services after any such changes constitutes your acceptance of the revised terms.
